In accordance with Ohio Revised Code Section 721.15, the Village of LaGrange passed Resolution No. 2012-773 expressing its intent to sell personal property, including motor vehicles acquired for the use of municipal offices and departments, and road machinery, equipment, tools, or supplies, which is not needed for public use, or is obsolete or unfit for the use for which it was acquired, by internet auction.
1. The Village Administrator shall be and is hereby authorized to place for auction and to sell to the highest bidder such unneeded, obsolete or unfit personal property, as may be authorized by resolution of Council from time to time, by internet auction.
2. Such auction shall be conducted by a representative pursuant to contract with the Village. The terms of sale will require receipt of payment in full prior to tender or delivery of such personal property.
3. Such resolution of Council may establish a minimum price that will be accepted for each such item and may provide for further terms and conditions, including but not limited to the website and identity of the servicer of the auction, requirements for pickup and delivery, method of payment and sales tax. Any such terms or conditions shall be contained in the advertisement for internet auction and shall be made available to any person upon request.
4. Internet auctions shall remain open for bidding for a period of not less than ten (10) consecutive days, including Saturdays, Sundays and legal holidays.
